Sir, the magistrate refering the case U/s156(3) but cannot booking FIR fourtwith.what is the next step I will take for my case?

approach the police yourself and seek registration of f.i.r or lead pre summoning evidence before the magistrate or file an appeal against order of magistrate dismissing your application u/s 156(3) crpc.
