Sir, One of my known person had taken a loan from me for Rs.2.5 Lakh against issuing a cheque & bond. He is running a travel agency and construction firm. He failed to repay the amount on said time and I have filed a suit under 138 which the case is under progress. He is not having any intention to settle the amount and not attending to my calls. Already now 5 months passed. My request /question are, can I file a civil suit against him. What documents are required to file the suit. How much time will it take to complete the case. Can I get interest for the amount I paid to him. What will be the legal expenses .Please reuest you to advise

you can file a civil suit for recovery under order 37 and the proceedings are summary so the chances of getting the decree are good.

You may file a civil summary suit under order XXXVII on the basis of cheque along with the interest. The expense is court fee on total - 2.5 L + Int + other costs - which is as per the tabulation for your state. Ofcourse, lawyer's fee is a relative term
