Legal Question in Criminal Law in India

Hi Sir/Madam,

I would like to known some legal conditions how to take action on this situation, my friend father was well educated person, his younger brother is not educated, for his brother life he gave his certificate his brother took that certificate and got job in some govt dept, now his is retrid and my friends daughter want to take action on his uncle, is it possible to go heard. and calm a compliant against him.
