Legal Question in Criminal Law in India
That my sister-in-law doing a g.d. against my elder brother and my mother but he did not lodge any g.d. against me and my father but she doing a 498a case by 156(3) in the court against me, my father, my mother and my brother. The police arrested my brother and me. and give the charge sheet in the name of all of four. Now my question is doing any g.d. in the name of me and my father she can lodge a 498a case by 156(3)? also I ask you without g.d. police can arrest me give a charge sheet? It is not duty of police to know the court that the applicant misguide the court? My father is a brain tumore pation.

she can proceed by making a complaint to CAW cell, or lodging an FIR straight to the police or filing a private complaint before the Magistrate along with an application u/s 156(3) of crpc to lodge an FIR.
she can even file a pvt complaint.
