Legal Question in Criminal Law in India
My son has just graduated from Columbia and has an offer start a training program in New York on OPT from 30 June 2011. He has an I-20 from Columbia and an Employment Authorization Card.
He traveled back to New Delhi to get his F1 visa (on OPT) renewed and at the interview the Visa officer asked him to provide Court documents showing no pending cases and/or dismissal of previous cases documents from the Courts of Massachussetts and New York, the two states he's lived in.
He had misdemeanor charges related to traffic rules violation in the Waltham court in 2009 which were dismissed with a fine. So we need help with getting court documents saying that the charges were dismissed. So that's one.
However, he has no record in New York. So we don't understand is what documents to get from New York Courts where there is no record. Could you please guide?

All he has to do is to apply to the prothonotary office at Waltham Court for a copy of the order of dismissal. Similarly to the office of prothonatry at New York that there is no case pending against your son.
In US, some sort of certificate might be issued by authorities concerned about pendency or otherwise of a matter.
