Legal Question in Criminal Law in India

Statement of personal details in departmental enquiry

R/Sir

I am a central government employee facing a trial under IPC 498A, 406, 420, 114, 323, 504 & 506(2) and u/s 3,7 of dowry prohibition act. Meanwhile my wife has filed a false complaint regarding my second marriage in my department with a copy to DSP for investigation, for which she has asked my department to remove me from my job as well as salary slip of last six months. The vigilance department of my department has approached me and has asked me to give a written statement for the same. So please advice me whether I have to give a written statement as per their request. They are not even giving me a copy of the said complaint. Moreover can my department give salary slip to her? Is it not against the service rules of the central government to give my personal details without my consent? Moreover please advice how to prevent from such false complaints?

Re: Statement of personal details in departmental enquiry

In a Departmental Enquiry, normally explanation is sought. It is upto you to give an explanation or not. If somebody makes false accusation or lodges a false complaint against you, you can initiate prosecution as also file a suit for damages.
