Legal Question in Criminal Law in India

we stay in a building consists of 4 apartments i.e., gound and first floor for the past 7 years. In ground floor one of the apartment ownders constructed a sit out with wall and a gate occupying the common space. Can we prosecute him.if so under waht act and sec?. i read a book of apartment ownership act 1994 which says this act is applicable for a building consists of 5 or more apartments or three or more floors. Kindly guide me.

I think so you are from Tamil Nadu. You dont think complicatedly. Just a suit for mandatory injunction to demolish the offending construction is itself enough to remove the encroached construction
