Legal Question in Criminal Law in India

Can the stay order given by supreme court be amended by supreme court later if it is required? Actually my brother is in judicial custody uder 498 A and my whole family is accused by my brothers wife. Our hearing is going in punjab and we stay in maharashtra. We got stay order from SC on any proceeding related to this case in punjab. But the opposite party used this stay order against my brothers bail plea in high court saying the bail plea also comes under stay. Can the SC amend the stay order notice so that my brothers bail is not affected by this stay?

Yes Supreme court can amend the stay order any time.

We are team over here in Punjab and Haryana High court at Chandigarh but we never see any judge considering such a narrow view in respect of bail. Anyhow you may approach to the SC and apply for amendment of your stay order. We may assist you in SC and High Court also and assure your brothers bail.
