Legal Question in Criminal Law in India
A takes a cheque from B without his knowledge. he gives it to C for some unlawful consideration. signature in the cheque is not that of B. cheque is returned. can C file a complaint against A for cheating and forgery? i undrerstand that title of the person is defective for an illegal consideration andthe instrument becomes void also.

You have to remember that only proving fact of forgery may not be sufficient to held A guilty. It has to be further proved further that forgery was committed by A.
