Legal Question in Criminal Law in India
Teja had taken goods from Kiran on credit Rs. 3,00,000/-. Teja had handover payment Rs. 3,00,000/- to Mayur to deliver Kiran. Mayur had issued 3 cheque to Kiran each Rs. 1 lac. Out of which one cheque of Rs. 1/- Lac dishonoured.
Kiran has issued notice for demand. Notice taken by Mayur's servant for Mayur and Teja but not informed to Mayur and Teja. complaint U/s. 138 filed by Kiran against Teja & Mayur.
Cheque signed & issued by Mayur. Not issued & signed by Teja.
1] Whether any offence committed by Teja U/s. 138 of Negotiable Instru. Act.
2] Whether Teja is joint & severally liable for criminal act.
