Sir i m a victim of this law my wife is asking my son whho is with me as compromise for settlement of the case high court had given the kid to me saying the dispute to be settled in family court .What r the consequences

what if i do not agree to give my child to her

r voice recordings any use under evidence pls reply

Since a case already been filed U/s.498A and same is not compoundable, you may have to face the same.

Voice recording or tape recorded evidence is admissible in evidence.

It is hard to prove a case like 498A in court.However everything depends on facts of your case and evidence your wife has against you.

Yes, voice recordings are admissible as evidence in Court.

You should try to settle the matter out of court. The child custody depend upon age of the child and financial/social status of both the parties.
