Legal Question in Criminal Law in India
I watched the Bollywood film Jolly LL.B. But I found some mistakes in it. I want you to ask these questions:
1) Can any Judge deliver any judgement without strong proofs? Can he deliver it becoming emotional?
2) In this film Judge charged the Accused (Rahul Diwan) under section 304 of IPC only, but I think that Accused is to be charged under some other sections ALSO for driving the car with drinking beer, breaking speed limit and killing people.
3) How a judge can allow Jolly (Lawyer from Prosecution) to bring the witness without sending any prior notice to the court?
4) Can any lawyer who has no relation with the victims file PIL in the court?
I have criticised this film for above points(excluding 4th question).
