Legal Question in Criminal Law in India

my wife filed DP 3& 4 AND 498A against me ,after 3 years gap she filed divorcee under disertion ground, now both the cases are in court ,she is mediating with the help of her relatives that she doesn't want divorcee and she is ready to join me ,she had also previously did the same ,she also promised me that she would take back all cases againt me ,but she didn't do so.

Now i fear taking her back as there are chances that she may file few more false cases ,Also i lost interest in her as my entire family is running around court because of her false cases on us.

Actually i didn't take single rupee as dowry ,even customs of marriage were denied by them, they didn't even gave me any gifts until now, even for marriage ,they demanded expenses to be shared by us immiiadetly after completion of marriage .

Now her uncle approched us with a proposal that she wants to join with me and promised it is his responsibility to make them with draw all false cases,i remainded him that they are not to be trusted as they have made similar promises many time before and didn't stand by that.Instead i asked him that all there family members should take independent undertaking by giving in written all the incidents from engagement time to till date, also they should in written give all the expenses they made before ,during and after marriage on us ,so that that can stand as a proof for me before court Hon'ble Court, against there false cases.

Does this undertaking( if they give) help me in fighting false cases they filed ,and protect me from future false cases ,in case they do so in future .

Should i take it in notory/legal document,( if they give )or is it enough if they give it in writting in there own hand writing on plane paper with there sign.

How far this document help me before court in proving my innocence, does such type of documents accepted /considered by Hon'ble Court.

KIndly help me know.

with regards,

rajiv

As advised before, you may try an amicable settlement. It may be better if you bring your wife back home.
