Legal Question in Criminal Law in India

My wife filed false 498a case against me and my family before 7 years. The is still in case, but now it is about to finish. Meanwhile I tried 6 times to convince my wife to come back home, but she refused. Now she is ready but with conditions that she wants separate home, near at her parental home at least for 1 year. She agree that she will ready to change home (near my residence only after 1 year, when she will confirm that I am really want to settle with her).

I am really confuse to divorce or to go ahead with her conditions (as we are having 6 year old daughter, for her future is this good idea to get compromise with wife). But my family is really against to back her home, but to divorce her. I am really confuse, that is this legally safe to get attach with her. Please suggest.

I will rather very strongly advise you to follow her conditions and settle your married life. Reason being that after marriage, the girl is to be transplanted in her new environment; failure in complete transplantation results in failure of happy and peaceful settlement.

Therefore, earlier you bring her back on her terms, better it may be for both of you.

i completely agree with Mr. Goel. its easier to divorce but the consequences may leave a negative impact on the tender mind of the child. keep your conciliation talks on.
