Legal Question in Criminal Law in India

My wife who is in her parents� house for last 7 months, went to woman cell charging falsely all family members with condition for going to rent separating me from my aged parents and on not accepting her condition due to her dominating / threatening attitude under influence of bad bad parenting support and her sister LLB practising. She gave an inflated list of stridhan / dowry items/cash through woman cell and demanding stridhan /dowry items. We are both govt. servants but she as a group �A� employee is earning more than me.

1. How can I get rid of her fake claim of jewellary / cash?

2. Should I submit dowry items in woman cell?

3. Can she claim alimony / maintenance during divorce proceedings?

4. How can I protect myself & family members from her false charges?

5. What action should I take against this inflated claim?

in case the claim is inflated, it has to be substantiated with the money spent and invoices obtained. one cannot claim the stridhan or expenses solely on the basis of oral testimony. you may move the court for anticipatory bail and cite this as one of the grounds. she can claim maintenance etc. during divorce proceedings depending upon your lifestyle and income but there are other factor governing mitigation of maintenance

You should first establish your bona fides by returning the 'istridhan' with supporting evidence about the expenses made by them in marriage without waiting for the police to ask you.
