Withdrawal of Case

Sir, We had filed a case in Police station for an issue. We also took up the issue to CM Cell. Now the defendant through a third party agrees to settle the issue by providing our amount to us with condition that we should take back our cases. Can you advice if it is possible to file a case again if the defendant does not keeps his promise.

If you withdraw case with leave of court to file again, then you may be able to file again.
