Legal Question in Criminal Law in India
Can the words used during enquiry proceedings in a departmental enquiry be treated as defamatory and a defamatory suit can be filed? The departmental enquiry proceedings are neither attended by any outsider nor published for public viewing. How to defend such a defamation case? The case has been filed (Civil case) by the chargesheeted employee against the presenting Officer.

in case the contents of department proceedings are violating the rules and bye laws and the contents are defamatory, the action may lie.
