Legal Question in Criminal Law in India

i was working a govt. office and had submitted a document to the head of office who directed the same to be handed over to the concerned clerk. No action was taken by the clerk and after one year, on enquiry, the clerk claims that he had returned the document back to me at the time of submission itself as no action was required.

The fact is that he did not return back the document and he fears that since it is more than one year, he may be proceeded against for inaction.

It is requested to kindly inform if i can prefer a complaint for criminal breach of trust by govt. servant in addition to requesting for departmental action.
