Legal Question in Criminal Law in India
X is director in public limited company and issued a cheque to partnership firm Y.The cheque was dishonored.Y initiated proceedings in court and within stipulated time frame.But the notice was served as proprietor instead of director.X's counsel objected to it and filed a plea to quash the case under 138.What step should Y take in his defence?

Some error may not be sufficient to quash a case. Engage suitable senior counsel to represent before the high court.
