Legal Question in Family Law in India

My 498A and DVC are running in court now i want file maintenance to my 5 years old son (for education,medical and food). Due to he doing business which is on his mother's name every document is on his mother name so he is misguiding court that he is daily wage labour. And in DVC they sanctioned me only 1000/- per month. Hence i appealed again. Now can i file maintenance to my son in other court which is near to my mother's house bcz my son is with my mother and i alone living in father-in-law named house (martial house). If we unable to show his earnings court will not saction amount to my son? pl. advise me sir what to do in this situation. (whether he can escape by telling that i can take care of my son keeping in govt. school with free cost).

Yes you can apply for maintenance u/s 125 Cr Pc
