Legal Question in Family Law in India

498A and other related acts!

I got married in 1990. We do not have any kids. Now my wife has implicated me & my familiy under section 498A IPC, 323 IPC, 116 IPC & 3/4 DP Act and I have filed divorce petition in Delhi District Courts.

If the case u/s 498A and other related IPC will be proved as fake where respondents were arrested, Can they lodge a counter FIR against them for misuse of those laws and a petition for defamation?

FIR can not be registered for false prosecution but you may approach the MM court by way of complaint case for false prosecution and you may also file defamation case both civil and criminal.It is also a good ground for divorce for which you must have to make necessary ammendments in your divorce case.In case of need contact with details,professional charges are applicable.

Sure they can; but for what ends? try to settle the matter once for all on whatever terms possible and bring peace to yourself and your family;

if you want to enjoy your life, you should make an effort to bring litigation to an end at the earliest;

there is no better way than a compromise, even if you need to swallow your 'ego' for a moment;
