498 Dowry Harresment

Hi,

I am a NRI currently residing in California.My wife left for India about 8 months back with out little son (16 months) who born in USA. We were married in India 2 years back under Hindu MArriage Act.Noe she filed a divorce in a Indian Family Court and her family ask me to come back for a compromise.As soon as I reached in India Police was waiting for me to arrest in my house in 498 A (they put40 lakhs pf rupees in the 498a).I some how manage to came back to USA. Now they are calling me back to come down again and do a mutual divorce.Now I am scared to go unless I have some document from them which state that there are no Dowry harressment.Could you please let me know what document do I need from them or what should I do? Thanks Sam

What you need, before yopu come back to India for mutual divorce, is an anticipatory bail granted by the Indian Court in respect of the 498A proceedings.

For this, you will need all the papers you have, such as, copies of divorce proceedings, 498A proceedings etc.
