Legal Question in Family Law in India
420 ipc
hi,
just engagement happend last year and marriage didnot happen at all to the eyes of law. but to our shockings the girl's father pressed charges against me and my family members under 420 IPC and DP 3 and 4. He made absolutely fasle allegations in FIR. he feels he has been cheated since marriage didnot take place between his daughter and me. He also mentioned that he gave us cash and gold at the time of engagement. he simply fabricated the story in FIR.
i want to know how can we defend ourselves against these false allegations. i havenot yet recieved any summons from court and it has been 4 months. how can we remove the charges against my family members from the caase. Please guide me.
thanks in advance

yes, you can defend allegations, however without going through the FIR or complaint , no specific advise can be given

It may not be that simple to answer your question. You may need to engage a lawyer, show him all your documents and explain the entire situation from day one till the last. Your statement may be missing on many aspects including your relationship with the girl, if any. The law of domestic violence has recognised even a live-in relationship as equal to marriage and has conferred several rigths upon the girls who may be found guilty of domestic violence.
