Legal Question in Family Law in India

In 1997 I got married, taken a lot of physical and mental abuse, left home when my son was 4 month old in 2001.. stayed separately for 7 years with no support from husband and finally took divorce. Had worked with good companies and had given a quality life to my son however gave his custody to my ex husband at the time of divorce as my job timings were at night and being an orphan, i have no one to look after him at night. Till 7 years, he used to be with my friends family at night and then i have put him in a boarding school in dehradun but due to unavoidable circumstances I have to leave my job and paying his boarding fee was beyond my limits. Though i asked my ex that if he can actually take care of our son which he agreed but he is same with him also. my son is subjected to physical torture. He hurl abuses and is just not concerned about his studies. My son is under a lot of stress and threat. He cries and tells me to take him in my custody. I told the same to his father that he wants to be with me & that he should give his custody back. He bashed my son badly and made him call me and said that he is okay with father and he never said that he wants to be with me.
