Legal Question in Family Law in India

for the last 1 year my wife is enjoying a relation with another guy over phone,when i pressure her to stop that things she does not.We have a child of 7 years.few days before i broke her mobile but she remain contact that person by telephone booth or others mobile. I have got some of her private message which she sent to that guy.Then i talked with her famaily about the problem,they talked with my wife and then they request me to give her mercy for that time and i agreed.But few days later they threatning me to kill or give a 498 case against us. So now i want to separate from my wife and want to take whole responsibility of my son as soon as possible and also want to know the legal process how i resolve the problem if my wife or her family lodge any case against me or my famaily.

You may need all the evidences to support your allegation. Since the child is already 7 years, you may be entitled to guardianship as well as custody. However, you may have to pay her adequate maintenance amount.
