Legal Question in Family Law in India

4 years back, Myself (co-owner)and my husband purchased a flat in b'lore worth 27 lac. Flat is in both our names, I being co-owner.

14 lac he took loan and 13.5 lac I paid. but I have proof only for 6 lac payment. now we are moving for divorce.

if he doesnt agree for 13.5 lac and say that only 6lac is paid by me, what can I do. will I have 50% share as property is in both our names? now the flat cost is almost 50 lac.can u guide please.

You don't have to prove the amount paid by you. You have equal right in the property. Further a new amendment is being introduced in divorce matters which will give you another 50 % share in the husband's properties also. Contact me for further advice at [email protected]
