Legal Question in Family Law in India

I ahve filed a case under DV act 2005 for residence order. However my husbands lawyer is arguing that i am working and earning hand some salary hence residence order should not be given.. Is his argument valid under law?

Will i get residence order or not?

as per law what i understood is if a person wants to get rid of his wife only option avalable is divorce.But he just cannot throw his wife out side right

residence is your right and your employment is no hurdle to it. you may seek the residence orders as per law.
