Alimony help
Interim order states that
1- 2nd marriage valid .
2-visitation rights given to father.Father to pay rs 10,000 pm for the two children .
3- Give a proposal for the ex wife.
Facts of The case
1- wife abroad for 4 years period but is intermittenntly coming to india and and avoids reciprocation of contact by husband but contests that husband her sent her abroad.
2- Period of desertion 4 years-
3- Children studied in very costly residential schooling abroad and also now in India
3-Passport evidence multple foreign trips abroad.
4-Wife claims she has no independent source of money on return and after the Bar oeriod of the 3 months over( infact 2 years after ex parte decree)
Evidence produced in court
1- Passport of wife with trips abroad
2- Residential schooling fee structure of 3 lakhs per annum
3- Email evidence of in job abroad and employed a maid in foreign land
4- Husbands salary after tax deduction is 55000 pm.
HOW TO CONTEST THE CASE
1-ask for the income tax returns for the foreign trips and costly resedential schooling in her own admission
2-Husbnd is salaried class.
