Legal Question in Family Law in India
Many thanks for answering my questions on Lawguru, regarding this question: I am resident in India on OCI (Due to get my Indian passport in 2012). My son and ex girlfriend are resident in NZ. How will i be assessed for child support? And can I contest an NZ order for the amount of payment in India?
I have a few more questions.
1. Can she force me to take a paternity test in India?
2. If I am found to be the father, how is the Child Support amount assessed (my guess is they would convert to NZ dollars and assess?)
3. What if I am unemployed in India? Do I still have to pay?
4. What if I never go back to Australia/NZ? Can they still hit me with Child Support payments?

in this situation, she cannot compel you for the paternity test unless she files a case in that regard here for declaration that you be declared the father. secondly, it would be difficult for her to go forum hunting between NZ and India. even if you do not go back to NZ, still she can obtain ex parte orders from NZ courts but it would be difficult for her executing the same here in india as India and NZ, to my mind, do not have a treaty in that regard.
