Legal Question in Family Law in India

Anticipatory Bail

I am married since 3 yrs and have 11 month old daughter ..My wife is having Very Low IQ ...went to Doctors...Not willing to take treatment ...I am totally fed with this behaviour ...want divorce ..they gave dowry...I never in 3yrs insisted on any extra dowy.

The most distrubing Part is my wife all her decisions are taken by her parents and her brother ...so i feel as if i am married to all of them except my wife !!!

Now they are threating Police complaint and legal action ...so could you please suggest me a good lawyer in Hyderabad who can get a anticipatory Bail ?

and also if a false allegation under 498 A is proved, Can we issue notices to her father's and brother's employers indicating that they have wrongly influenced her and will there be any kind of punishment for them ..because the psychologist who counselled us told clearly that she is under their influence ..and i am wasting my life ?

Re: Anticipatory Bail

It will be better if you yourself look an advocate in Hyderabad locally. First you save yourself, than think about taking action against in-laws. we cant take action against employer.

Re: Anticipatory Bail

gentleman, the opinion of psychologist as mentioned by u is not enough to conclude that she is not of sound mind;

being under the influence of brothr , father or family of origin is not an offence;

you are forgetting that after marriage, the process of settling down for the girl is like that of "transplation" and u have to provide enough fertilizer the transplanted plan to grow;

a woman, when she becomes part of the matrimonial home, is to be provided highest degree of emotional security to enable her to forget her family of origin; in this case you failed in your duty and therefore she still depended upon her family; sooner u realise this fact better it would be for you;

my advice, therefore, is forget lawyers and repent for your deficiency in your behaviour; apologise to her and her family and try to work for a settlement; do not forget she is the mother of your child too;

please try conciliation methods and avoid litigation;

Re: Anticipatory Bail

Engage any experiance lawyer of Hyderabad for the anticipatory bail.

If you prove the action taken against you u/s498A is false than you may take the criminal action only against the complainant.

That your wife is under the influence of her other family members, give no legal right to you for taking any action against them provided you prove on record with strong documentary proof.
