Legal Question in Family Law in India
I have applied for maintenance for me and my 8 year ol girl from my husband, in a civil court. No divorce petition has been filed. He committed adultery and now denying the allegations. We earned in US and I dont have a penny with me now. Everything I put it in the family and now he is claiming that I have taken all the money. He is denying to return my jewels and stridhan. He is denying to give alimony to the amount we claimed for. He is earning 35 lakhs per annum. How much I am entitled for alimony? I would like to get a permanent alimony or one time settlement. Please advise.

As you are based in Chennai and claiming monthly alimony, it is possible you have filed the case in Family Court, Chennai.
You have to take steps through Police/ Dowry Prohibition Officer for recovery of your items by filing criminal complaints.
You can get a fair amount as alimony on one time basis or on monthly basis regardless of your decision to divorce or to continue the marital status.

The court may give you both options - permanent alimony and a monthly allowance - at the time of final decision. Meanwhile, you may continuing getting monthly maintenance during pendency of your petition.
