Legal Question in Family Law in India

Hello,

My brother is married for 7 years but is unhappy as his wavelength doesn't match with that of my sister-in-law. They are a complete mismatch in every respect and the marriage was an arranged one in India. They have a 6 yr old son. MY brother is deeply in love with another woman for the past 3 years but could propose her only a year back. She is an extremely nice lady and he is unbelievably happy with her past 1 year.

How can my brother get a divorce (which will not be given easily by his present wife) and what's the procedure?

His only option is to file for divorce on the grounds of cruelty against his wife since she does not want to settle it. But he should not marry with friend until divorce. If he remarries without divorce, there will be great difficulty to him.

The brother can file for divorce by taking one of the grounds mentioned in the act but my suggestion to your brother is that do not get married before getting a divorce from his 1st wife as the 2 nd marriage without divorce from the 1st wife would make his life hell.
