When does a case go to LOK ADALAT.I had filed a case of DVA 4 hearings have passed and my husband has filed Divorce case in which 1.8 years have passed.when can a judge send it to LOK adalat..Does the lok adalat give the verdict/judgemenet in the first hearing itseld. matters are referred to lok adalat only if both the parties agree to the reference and the judgment of lok adalat also depends upon the settlement of both. in case the terms and conditions are agreed upon, the disposal would not take much time.
The court may, on its own, send a case to Lok Adalat more particularly where there chances of "summary disposal". The court is not bound by consent of parties. The Lok Adalat may decide a case after hearing the parties and perusing evidence available on record. The judgement of Lok Adalat is enforceable like a court decree.
WELL the case is as simple as if you wish to transfer the case for lok adalat you and your husband had to seek permission form the court jointly for transfer of the same and the court if satisfied will transfer the same to lok adalat where the judgement of the lok adalat stands final and unquestionbale and unappealable.
