I was going through the cases of dv act, sec 125 and 498a
I was asked to pay only rs 1200 as maintenance , i proved my income of rs 4000 only and my wife as employed in a reputed co. And her income of rs 10000
I was also disowned by my parents
Then we took mutual divorce last month.
Now i want to file custody case for my 5.2yr old son
Now, can i declare my income more then her.?
And living with my parents
Will it goes against me

You have to forget custody considering that you suppressed income to avoid paying Maintainence, if you have Any proof that Wife is unable to take care of the child properly then the court might give you custody, remember merely having income will not get you childs custody, also it will also depend on what you have agreed in divorce judgement.
