Change in name of the biological mother on a child's records without her consent

Can a father change the name of the biological mother on a child's records to that of his new wife without the mother's consent. they are divorced and father has custody of the child (which was given out of court by the mother after a verbal promise that he would never remarry)?

The mother's name may not be changed without the child having been adopted by someone else with the consent of biological mother.

it should not be changed but i think that if they are having the custody then removing your name will only benefit the children as he/she will not get confused on available parents and the parents who gave birth.

the break in marriages bring such unpleasent issues so look for what is better for your child.
