Legal Question in Family Law in India

Change of name and effect on f 1 visa.

Miss R B , is studying mph at st. Louis univ., since aug., 2007, on f 1 visa from india.

Her mother has divorced recently and got remarried on 15th dec., 2007.

Now, R B wants to change her name from B to her new father's name R J

Is it ok, possible, legal?

What happens to her f 1 visa?She is reaching india- mumbai on 22nd dec., 2007, for change of name.

Does she use the same visa stamped on current passport or she has to apply for new visa?

University has assured her to send new i 20 form, no sooner we send copy of new passport, with changed name.

Please advise urgently. It will help making career of a student.

Dear Mr Mehta

(a) First of all, the change of name is not required;

(b) Secondly, the student can make an application for change of name in USA itself by making an application to the Indian Consulate there;

(c) The candidate does not have to travel to Bombay for this purpose; and if at all the candidate is going to Bombay, the name change transaction can still be done after return to USA on the same very passport and visa;

(d) If the candidate seek change of name in USA, the same shall be incorporated on the passport by the Indian Embessay; and then one can apply to BCIS in USA for name change in the visa and with SEVIS.

(e) Of course the desired change can be got done in India; but then a new I-20 should be obtained and on that basis new F-1 visa will have to be applied for. However, this will be the lengthiest procedure one would be following.

whats the need of changing name....... anyway name can be changed at the place where u are residing and more importantly where he is supposed to live.
