Legal Question in Family Law in India

chargesheet under section 498-A

Police registered case against me & my Family members under section 498-A , section 4 of Dowry Prohibition Act & 506 section on compliant of my wife.

Police submitted challan just few days back in the court of Judicial magistrate after near eight months of investigation under same sections.

I have already got anticipatory bail in this case. I am central government employee.

My question before learned advocates is that ''chargesheet against any government servant in criminal case in judicial court under above sections'' will effect his job(like suspension etc.)? or there is no need to worry till no adverse judgement given by court

no it would affect ur job in either case as you have not been convicted by the court. once u r convicted, only after that the suspension would be considered by the authorities pending appeal.

Accused is presumed innocent unless otherwise is proved or convicted. Convicted person cannot continue service. Some time mere complaint is considered to take action by the departmental authorities by departmental action.

Try to compromise with your wife, after she is your wife and needs love and affection. Settle all your disputes with her avoiding litigation which may harm not only your family life but business life, too.

Wish you better luck.

Nothing to worry till trial is completed.

However, you should make all out efforts to settle the matter and reach a compromise with the girl.
