Legal Question in Family Law in India

Child Custody - 2

In continuation to my previous question thank you all for your replies. However I want to keep my children with me and I want legal choices and options to do so. I do not want the divorce or my children away from me in Kolkatta.

Also to be specific in my question:

1) From startof verbal divorce/seperation talk between her and me and till the time the court actually grants verdict, can she take the children away from me and to another city?

2) What measures can I take now to prove that I shall bea better parent?

3) She has always got money and support from her family and they too support her. They are fair but they believe I am giving her-hard time.

4) I am willing to give her an apartment in the same city and pay for her maintenance but have the children with me and she can visit everyday or come and stay, no restrictions. But I want the children with me because I hope that with that scenario she will come back to me.

Please help.

Re: Child Custody - 2

(1) Yes. She may take the children with her away from you to another city.

(2) Bring all facts on record; and establish your bona fides by spending appropriately upon the children and their mother.

(3) You should ignore support available to her from her family; and should consider providing sufficient support from your income.

(4) You want contracts and negotiations without actual action which is the foundation of a family. The love, affection, care and support you want to shower on your family should not be conditional. Keep making genuine efforts, and other things may follow.
