If you have eecided on a seperation and/or a divorce, you may file seperation/divorce proceedings, and also file a petition for child custody. Being a mother and the child being only 4 months old, you will surely get the custody.

I have gone through your query. But you have not given any reasons for sepration. As you said that you have 4 months old baby. I think you are taking hasty decision by separation, you should think about your child future. I suggest try to sort out your problems and consult with your elders and take their openion and also consult advocate.

Carry on the cusdoty of the of 4 months baby girl and you have every right to retain the same as you are the mother and natural guardian of the child. However, it advicable to you to sort out marital dispute keeping in your mind the future of the Baby.

Incase if you have firmly decided to get separaion then you while getting separation, may get the full time cusdoty order from the competent court court. The paramount consideration for the court will be welfare of the child.

i full hartedly agree with sh M P Sanjay and sh Rajeshwar Sharma

though u can take custody but dont think that ONLY you can take custody. looking in to her welfare court may decide otherwise too if conditions are like that.

try to resolve the issues as your personal issues will effect the life of child. i hope you are concerned about the child too. father also is important for a girl.

seperation must have been thought before planning the baby. you people are just too much careless regarding child welfare.
