I was married on 26/10/01 n was sent back to my maternal house on 6/06/02.I was expecting at that time.When my daughter was born none of my in-laws or my husband visited us despite being informed,he filed a divorce case,which later on he has taken back this year n now he wants the custody of my child.She is Just 3 now..All the expenses at the time of delivery of thereafter have been met by my parents.My husband never came to meet us nor he has seen my daughter.I m working and earning more than my husband now...I dont want my daugter to be taken by him as i believe the person who never came to see her cannot bring her up..He will harm my daughter in the same way he used to harm me,he thrashed me,draged me by my hair etc.We had filed a case under sec 498A but still there is no conclusion to it.The case was filed from UP but now i m based in Haryana...Please advice me how can i restrain him from my daughter's custody...

In the brief facts given by you, it appears that you may yourself file a divorce petition and in that petition also claim custody of the child. In the circumstances, as stated by you, you may succedd in getting teh custody

It should be possible to restrain him from taking over your daughters' custody while your husband may have a right to visit her.
