about child who is 1 1/2years

iam mother and my husbend died last year and my in laws are teasing me to give baby back to them but i could not i need this baby because she is small and can you give me answer there is any law like that

Madam,

We feel sorry for your Husband.

As as per your statements. Under Hindu Law or any other law the first right on the Baby is of mother. no force in this world can take that away from you.

As per Hindu Law, Till the time baby is of 5 years mothers has a rightful and Lawful custody of the child.

Further, you have a right to claim maintainence for the child and for yourself from the in-laws.

there is no law which allows your in-laws to take away the child from you. The custody of the child shall remain with you till the child is major; In case any body teases you or cause you or threaten you any harm, you may seek police protection.

You have the Constitutional right to have the baby being her mother.

No one has the right to take the baby away from you unless they prove you are insane, mentally unstable, etc.

After Father the mother is natural guardian of the child so in laws have no right when father or mother is alive.Moreover upto 5 years of the child the mother has a right over the child more than the Father so don't worry and accept my condolences for your husband's death.
