Christian Divorce Laws

Hi,

I am a christian and married in 2000 to an Indian settled in Australia, She is an Australian Citizen and holds an Australian Passport. The marriage was held in India in a church, I went to Australia on a spouse visa and due to Domestic Violence from my wife I could stay no longer and came back to India and live in India. In the meanwhile she has got a kid and now I would like to apply for a divorce as I no longer feel she needs me as her husband(till now I have not seen my sons photograph, he is 6 months old) She has not contacted me and I am not going to ask for child custody. As I want to apply for divorce, I do not know if I will be granted divorce. I need some expert advise on what will be my situation,please advise.

There are two important questions which need to be answered before a strategy for divorce may be worked out. First, the marriage was according to what rites and where did it take place. Secondly, how long did you stay at Australia with your wife, before coming back to India.
