cognizable offence & delay police action
Sir,
I filed a FIR u/s 498A ,406
against my husband & in-law
at Asansol, W.B. on 19.07.07.
Husband & in-law staying at
Kolkata. But the police has
not taken any action till now
in the plea of investigation and as a result the opposition get time for their
prevention.
Pls. Clarify :- Is there any time limit from the file of a
FIR u/s 498a, which is cognizable
offence, to take action action
by the police & Is investigation
and issue of warrant is require to arrest the culprit ?
What will be my next step if
further delay by police?

there is no time limit and you may file the petition under sec 482 of cr.p.c

Incase of 498-A time limit is 3 years but in case of 406 there is not limit.You may write to higher authorities or can move high court in writ or u/s.482 cr.p.c.

There is no time limit for the police to complete investigation.
You are at liberty to file a criminal complaint in the appropriate court seeking progress of investigation by police and / or summoning of the accused persons to face trial.

There is no time limit.
You may file petition in High Court u/s 482 Cr. P.C. in thsi regard

You seem to be in tearing hurry. It was only on 19.07.2007 that you filed complaint and its only 7th Aug today. There is no time limit. What are the preventive measures according to you opposition has taken. I know u have suffered a lot but please have faith in legal system and dont worry about the imaginary delays. There is none. You will get justice sure. Wait for at least another 15 days from today. If nothing happens till then write to me again.
