Legal Question in Family Law in India
I had a complaint against my in-laws, husband and sis-in-law for which an FIR was registered in AUg 09 by CAW cell. All mediation efforts have failed. My in-laws are mocking at the legal system and have bluntly refused to reconcile and have refused to retun back my STRIDHAN I was forced to go back to my parents house . I have been living with my parents for the last 2.5 years. I do not have a child bec his mom would not let us even sit together. I have rec all of my belongings except for some furniture and the entire Stridhan. I do not want a divorce as my husband is doing this under the influence of his mother. Divorce proceeding are on which were filed by husband and uptill now thrice they have been penalized for not submitting replies on time and i also got 25k for litigation charges. He is earning around 50k per month and i am earning 40k. I had filed a DVA case last year but it's going very slow. Please advice what can i do to save my marriage. Will the judge take my husband's side bec i have got 70% of my belongings back or the court can issue residential order as already 1.3 years haev passed in DVA. In the meantime Chargesheet has also been filed and the hearing is in this month. Will my in-laws be summoned and what if they are not ready to take me back??Please reply.

your DV case is going slow as the same needs to be disposed off within 60 days. however due to pedency of cases, the courts go slow. in case you lawyers presses for reliefs in DV, you would be getting your stridhan, compensation, residence orders etc...
moreover return of streedhan has nothing to do with saving your marriage. Streedhan returned and marriage still can be saved.
See what Ill suggest that since you want to save your marrital life, you should go for the Sec. 9 of Hindu Marriage Act (asking the court to grant orders for the reunion of both of you) where you can plead the court for the mediation and try to resolve the disputes.
