Legal Question in Family Law in India

I'm contesting an Annulment case filed by wife on ground of my impotency. So, I want to go for medical test and submit the report in court with my reply to avoid the delay of she moving an application in this regard. On enquiry i cam to know that doctors would not issue such cetificates on personal request. Is it true? Is there anyway to get impotency certificate on my personal request from a private/goverment doctor? plz help

You should keep in mind that one may be impotent ALSO qua a particular woman though generally he may not be impotent. Therefore, if your wife has alleged that you are impotent, you may hardly prove your potency. Even her pregnancy from you will not prove that you are not impotent because there are instances where impotent men have been able to produce children. I am handling a case where the wife has given birth to two children but alleged that the husband is impotent even though the children are from his sperms only. Such cases technically are called fecundation ab extra. Reference may be made to pages 298-299 of Marriage & Divorce by A. N. Saha (6th edition).

you can move an application before the court that you are ready for your medical examination and the court would constitute the panel of doctors for this purpose. you need to get the same done privately as you might have to go through it again through court.
