Legal Question in Family Law in India
Continuation of divorce
Sir,
I think my previous question was not properly drafted. So I am asking the same question again. I got married 2.5 years back and came to my parents place in jan 2007 and filed a case against my in-laws in women commission. To counter attack this my husband had filed a restitution of conjugal rights. with the efforts of court and women commission we were united in sep 2007. but my mother in-law created problem and we had a heated argument in women commission and i came bk to my parents place in march 2008. i was advised by women commission to lodge a case with women cell which i did in may 2008. Now my husband wants a divorce and has put false allegations of cruelty against me. we have had 3 hearings but my hubby is refusing me to take back. will a case of domestic violence help. what should i do to get bk in my matrimonial house...i do not want divorce as the root cause of this problem is my mother in-law.

Re: Continuation of divorce
In the given situation you may reconsider your decision and try to negotiate for divorce on your terms as to alimony amount etc.
Re: Continuation of divorce
Try for conciliation with him and set up a separate matrimonial home. You can very well defend the divorce proceedings and disprove the case of cruelty put forth against you.
Be that as it may, a case for domestic violence can be filed against your mother-in-law.
