Legal Question in Family Law in India
Continuation of divorce-third question
Thanks Sir I really appreciate your quick response and your positive response has given me some solace. My husband is being very rude and adamant and is not ready to take me back. What orders can court give in favour of me so that I can reunite with him. the charges that he has filed against me is that i was rude and abusive with my in-laws and sis in-law and did not cohabit with him, which is a white lie? Would just need your advice that what can i do so that main culprit-my mom-in-law is cross-questioned by legal authorities. uptill now only my hubby has been callled in women cell and tis hazari. can my case in court get into mediation?
what can the law do if my husband keeps on refusing to take me back and what all cases i can file against him. what all things can i get back , maintenance, money spent by my parents in my wedding if GOD forbid my marriage breaks

All you need is to ask at women cell that you want the matter for mediation. The trained mediators appointed through Delhi High Court Mediation Centre visit women cell every day for women interested in mediation. Secondly, you may request the judge in Tis Hazari to refer the matter for mediation when the other side is appearing.

You may consider filing a case under DVA against your husband and other persons, if any, who committed cruelty against you.
You may claim your entire 'istridhan', the wedding gift from both sides, money spent on wedding AND maintenance / alimony as per the standard of living of your husband.
You may also institute criminal proceedings against your mother-in-law if she had committed any cruelty / violence upon you.

To re-unite with your husband you can only file a petition for restitution of conjugal rights. I am not sure from which city you are. Supposing you are in a city where family courts are available then you can try to settle the matter through mediation and counseling in family court even in the divorce petition filed by your husband.
