Legal Question in Family Law in India

Court Fee

This is in response to the answer I got from you. My Petition has been filed at the Tiz HAzari Court , Delhi. The order passed on it states that either I should revalue my petition which is not possible, or approach a lower court than an ADJ or pay the court fee to the amount of 1,50,000 on my Petition under sec. 18 and 20 of HAMA. Would lke to add hear that I have been abandoned along with my daughter at my parents place before the delivery and my Husband has been a drug addict which i came to know after marriage

Re: Court Fee

There appears to be a fault in the legal course / method adopted by you for claiming the maintenance for yourself and your child.

Re: Court Fee

as i had mentioned in my earlier reply, in case you do not have an source of income, u may sue your husband as an indigent person whereby the court fee would be waived off. there is no point in lowering down the amount to maintenance claimed. there is another remedy, till the time ur application to sue as an indigent person is not decided, u may file a criminal complaint u/s 125 of crpc and u would not be required to pay any court fee on the amount claimed. u need to act fast before u get frustrated running around from one court to another.
