Court Fees

I am a hindu female claiming maintenance for myself and my daughter under HAMA 1956. My Petition has been filed in the court of an ADJ. I have claimed 1.25 lakhs per month as maintenance in proportion to his income which is 24 lakhs per annum.under section 18 and 20 of the HAMA. The court is demanding a fee of approx. 1,50,000 as the rule is the sum demanded *12*10. I need to know the following

1.) How can such a court fees be demanded in a maintenance case?

2.) Is there a court lower than an ADJ which has the pecuniary jurisdiction to adjudicate my case?

3.) How long would it take to get Interim Maintenance and if there is a cort with the jurisdiction what is the procedure?

You may file an application under DVA on which there may hardly be any court fee.

The court fee on an application under HAMA used to be only Rs.One and Paise Twenty five Paise in Punjab, Haryana and Chandigarh. Please write me back the place where you have filed your application and I will check up again.

There may possibly be some communication gap between you and your lawyer. Please check again from the court or show me the order passed by the court asking for 1,50,000 as court fee on an application for maintenance.

You may also buy a "Court diary" which contains correct information about court-fee payable on various types of petitions in the State concerned.
