Legal Question in Family Law in India

My cousin is an Indian citizen, she is married as per Hindu tradition in February2007. Her marriage is not registered in any state of India. She is living apart from her husband since April 2008 till now. They are mutually divorcing now, which will be finalized in feb 2012

she met another guy this year and they want to get married in March 2012, The boy is a Spanish national and she is an Indian origin. The want to get married in SPAIN

1. Is it possible for them to marry?

2. She needs a certificate saying she is eligible to get married,When can she obtain that? Will divorce sentence be sufficient?

3. What is her marital status at present, Internationally?

Please guide.

2) She will get the Decree of divorce after the 2nd motion from the court.

at present, she is married and once in February, 2012, divorce decree is issued, she may get married to the man of Spain. the decree of divorce by mutual consent is sufficient for her to start a new life.
